These Terms of Use explain the basis on which Next Kin LPAs provides Lasting Power of Attorney document drafting and administrative support services. Please read them carefully before using the website, submitting an application, or making a payment. They do not replace independent legal advice.
1. About Next Kin LPAs
Next Kin LPAs is a trading name used for document drafting and administrative support services for Lasting Powers of Attorney in England and Wales. We are not a law firm, are not acting as your solicitor, and do not provide legal advice. Using our website or services does not create a solicitor-client relationship. 2. Our Services
Our services may include preparing LPA documentation from the information and instructions you provide, administrative support, optional home-visit or paper-document services where selected, and onward submission to the Office of the Public Guardian (OPG) where this is included in your chosen package and you instruct us to do so. The exact scope, price and any optional add-ons are shown on the website or confirmed to you before payment. We may decline an instruction where we cannot provide the service appropriately, where information is incomplete, or where we reasonably believe independent legal advice is needed. You are responsible for arranging an eligible certificate provider unless you have separately purchased a certificate provider service from us.
3. Your Instructions and Responsibilities
By placing an order or submitting an application, you confirm that you are at least 18 years old, have authority to give the instructions, and will provide information that is accurate, complete and up to date. You are responsible for checking all drafts carefully before signing, ensuring that attorneys and certificate providers are willing and eligible to act, and returning signed documents within any stated timeframe. We rely on the information you provide and are not responsible for errors, delays, rejection or additional costs caused by inaccurate, incomplete or late information or documents. You must not use our services to make an LPA for a person who lacks the capacity required to make it. If there is any doubt about capacity, undue influence, conflict or the suitability of the proposed arrangements, independent legal advice should be obtained.
4. Prices, Payment and OPG Fees
Our service fees and optional add-on prices are displayed before you place an order. Payment is required before we begin work unless we agree otherwise in writing. OPG registration fees are separate government fees. The amount shown on our website is based on the current OPG fee and may change if the OPG changes its charges. The number of OPG fees depends on the number of LPAs in your order. Where an OPG fee is included in a package, this will be made clear at checkout. Any discount applies only as stated at the time of purchase. Unless we expressly say otherwise, discounts apply to our service fee and not to OPG fees or third-party charges.
5. Starting Work and Your Cancellation Rights
If you are a consumer, you may have a legal right to cancel a distance contract within 14 days of entering into it. If you ask us to begin providing the service during that period, you agree that we may charge a proportionate amount for the work completed up to cancellation. Where the service has been fully performed with your express request to begin during the cancellation period and your acknowledgement that you may lose the right to cancel once it is complete, your cancellation right may end when the service is fully performed. To cancel, email [email protected] with a clear statement of your decision. Nothing in these Terms limits your statutory consumer rights.
6. Refunds
If you cancel before work has started, we will normally refund the service fee paid. If you cancel after work has started, we may retain or charge a proportionate amount for work completed, subject to your legal rights. We will consider refunds where we have failed to provide the service with reasonable care and skill. We do not refund fees for work properly completed or costs caused by information, instructions or documents that were inaccurate, incomplete or late. OPG fees are government fees and are subject to the OPG's own rules. Where original signed hard-copy documents are not received in time for onward submission, the relevant OPG fee may be lost. If this happens because documents were not returned by the stated deadline or for another reason outside our reasonable control, we are not responsible for that lost OPG fee.
7. Timescales and Third Parties
Any timescale we give is an estimate, not a guarantee. We are not responsible for delays caused by the OPG, courts, postal services, payment providers, certificate providers, attorneys or other third parties outside our reasonable control. OPG registration decisions and processing times are controlled by the OPG. We cannot guarantee that an application will be accepted, registered or processed within a particular period.
8. Our Responsibility to You
We will provide our services with reasonable care and skill. We do not exclude or limit liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation. Subject to the previous paragraph and to the fullest extent permitted by law, we are not liable for indirect or consequential loss, loss caused by third parties or public authorities, or loss arising from inaccurate, incomplete or late information or documents supplied by you. Nothing in these Terms affects rights you may have under the Consumer Rights Act 2015 or other applicable consumer law.
9. Website Use and Intellectual Property
You may use this website for lawful personal purposes. You must not misuse the website, interfere with its operation, attempt unauthorised access, or use its content for commercial purposes without our written permission. The website content, branding, templates and materials are owned by or licensed to Next Kin LPAs and are protected by intellectual property laws. You may download or print material for your personal use only.
10. Bereavement Support Service
Our Bereavement Support service provides practical information, signposting and administrative support following a bereavement. It is not counselling, therapy, medical care, legal advice, financial advice or crisis support. We are not counsellors and do not provide mental health treatment. If you need emotional, medical or urgent support, please contact an appropriately qualified professional or an emergency service.
11. Privacy
We process personal information in accordance with our Privacy Policy, available at https://nextkinlpa.co.uk/privacy. Please read it to understand how we collect, use, store and share personal information.
12. Complaints
If you are unhappy with our service, please email [email protected] with details of your concern. We will review it and respond within a reasonable time. 13. Changes to These Terms
We may update these Terms to reflect changes in our services, pricing, legal requirements or business practices. The version published on this website applies to future use and orders. For an existing order, the terms in force when you placed that order will apply unless a change is required by law or we agree otherwise with you.
14. Governing Law
These Terms are governed by the law of England and Wales. If you are a consumer, you may bring proceedings in the courts of the part of the United Kingdom where you live, where applicable.
